Terms and Conditions

1. Scope of Application

These Terms and Conditions (hereinafter “T&C”) govern the use of the platform www.partut.com (hereinafter “Platform”) by all registered users, including Content Creators and Buyers. By registering or using the Platform, users agree to these T&C in a legally binding manner.

2. Description of Services

The Platform provides the technical infrastructure enabling Content Creators to upload, display, and sell digital content. Buyers may purchase such content for a fee. The Platform acts solely as a technical intermediary and is not a contractual party to any agreements concluded between Content Creators and Buyers.

3. Registration

Using the Platform requires the creation of a user account. Users must provide accurate and complete information during registration and keep their login credentials secure. The Platform reserves the right to decline registrations without providing reasons.

This platform contains content intended exclusively for adults. By clicking “Yes”, you acknowledge and confirm that you are at least 18 years of age (or the legal age of majority in your jurisdiction).

If you are under 18 years of age or the legal age of majority, you must not access or use this platform. By proceeding, you certify that you meet the age requirements and that accessing adult-oriented content is legal in your location.

4. Obligations of Content Creators

Content Creators legally confirm that they hold all required copyrights, usage rights, and exploitation rights to any content they upload. They undertake not to upload unlawful content and to comply with all applicable legal regulations. Responsibility for the legality and accuracy of content lies solely with the respective Content Creator.

5. Licensing and Usage Rights

By uploading content, the Content Creator grants the Platform a worldwide, time-limited, non-exclusive license to process, store, display, promote, and deliver the content for technical and operational purposes. Buyers receive a non-exclusive, non-transferable license to use the purchased content in accordance with the terms defined by the Content Creator.

6. Pricing and Fees

Content Creators set the sales prices of their digital products independently. In addition to the listed price, Buyers pay a platform and transaction fee of 15%. All prices are exclusive of applicable taxes unless otherwise stated.

7. Payouts to Content Creators

Payouts are made once the account balance reaches a minimum of 20 EUR. A payout can be initiated no earlier than 14 days after the Buyer’s payment has been received. Content Creators are responsible for providing correct payout information. For the payout transaction, an amount of 8 EUR per payout is deducted.

8. Payment Processing

Payments are processed through external payment service providers. The Platform assumes no responsibility for the functionality, fees, availability, or performance of such third-party providers.

Payments are considered final. As a general rule, we do not offer refunds once a payment has been processed.

However, if you believe a billing error has occurred or there are exceptional circumstances, you may contact us within a reasonable timeframe. We reserve the right to review such requests on a case-by-case basis.

Nothing in this policy affects your statutory rights under applicable consumer protection laws.

9. Liability Disclaimer of the Platform

To the maximum extent permitted by law, the Platform excludes any and all liability. In particular, the Platform is not liable for:

·         content, legal infringements, or contractual breaches by Content Creators;

·         lost profits, indirect damages, consequential damages, or financial losses;

·         interruptions, technical failures, data loss, or service outages of the Platform or third-party providers;

·         incorrect information or misconduct by users;

·         the legal, qualitative, or substantive nature of digital products offered on the Platform.

The Platform is liable only for damages caused by gross negligence or intent. Any liability for slight (ordinary) negligence is excluded to the extent legally permissible.

All content provided by us is for authorized use only and is subject to applicable terms and conditions. The reuse, redistribution, reproduction, or unauthorized sharing of our content by consumers or third parties is strictly prohibited.

We accept no responsibility or liability for any leaks, disclosures, or unauthorized distribution of content carried out by consumers or other third parties. Any such actions are performed without our authorization and are solely the responsibility of the individual or entity involved.

10. Termination and Deletion

Users may delete their account at any time, provided no open transactions remain. The Platform may suspend or delete accounts in the event of violations of these T&C.

11. Data Protection

The processing of personal data is carried out in accordance with the current Privacy Policy available on the Platform.

12. Place of Jurisdiction

All disputes shall be governed exclusively by Swiss law. The place of jurisdiction is Bubikon, Switzerland.

13. Amendments to the T&C

The Platform may amend these T&C at any time. Significant changes will be communicated to users. Continued use of the Platform constitutes acceptance.
